Welcome to MeSober! These Terms of Service ("Terms") govern your use of the MeSober mobile application and related services (collectively, the "Service") provided by DENIS MOSKALETS autonomo ("we," "us," or "our").
By downloading, installing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Important Disclaimer
MeSober is a lifestyle and habit-tracking application for entertainment and personal use only. It is not intended to provide medical advice, diagnosis, or treatment for alcohol dependency or any other health condition. Always consult with qualified healthcare professionals for medical advice.
2. Age Requirement
You must be at least 17 years old to use this app.
MeSober is rated 17+ because it tracks alcohol consumption, which is a regulated substance for adults. By using this app, you confirm that you are at least 17 years of age.
3. Description of Service
MeSober is a mobile application designed to help users track alcohol consumption and maintain healthy habits. The Service includes:
- Daily check-in and progress tracking
- Voice recording features for logging consumption
- AI-powered analysis of voice transcripts
- Push notifications for daily reminders
- Calendar and visualization features
- Optional data synchronization across devices via iCloud
- Friends feature for sharing progress with other users (optional)
- Poke notifications to encourage friends (optional)
- Analytics for product improvement
- Crash reporting for app stability
- Data export functionality
4. No Account Required
MeSober does not require user registration or account creation. Your data is stored locally on your device and optionally synced via Apple's iCloud service, which is managed by your Apple ID settings.
5. User Responsibilities
5.1 Acceptable Use
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Transmit any harmful or malicious code
- Violate any applicable laws or regulations
5.2 Accurate Information
You are responsible for the accuracy of the data you enter into the app. We are not responsible for decisions made based on incorrect data entry.
6. Privacy and Data Protection
Your privacy is important to us. Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key privacy points:
- No user accounts or personal information required
- Your consumption data stays on your device and iCloud
- Voice transcripts are processed but not stored
- Only device token and timezone stored on our server for notifications
- You can delete all data anytime using the in-app button
7. AI-Powered Features
AI Accuracy Disclaimer
The AI-powered voice extraction feature provides estimates only.
- AI-extracted alcohol unit counts may not be 100% accurate
- Always review and verify the extracted data before confirming
- Do not rely solely on AI extraction for any health-related decisions
- The AI may misinterpret certain phrases, accents, or terminology
- You can manually edit any entries to correct inaccuracies
8. Intellectual Property Rights
8.1 Our Rights
The Service and its original content, features, and functionality are owned by DENIS MOSKALETS autonomo and are protected by international copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain ownership of any content you create within our Service (notes, consumption logs, etc.). This content is stored on your device and iCloud, not on our servers.
9. Service Availability
We strive to provide reliable service, but we cannot guarantee that our Service will be available at all times. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical difficulties
- Third-party service interruptions (Apple, AI providers)
- Force majeure events
10. Third-Party Services
Our Service integrates with third-party services:
- Apple CloudKit: For optional data synchronization and Friends feature
- Apple Push Notification Service: For daily reminders and poke notifications
- AI providers (OpenAI, Groq): For voice transcript processing
- PostHog: For analytics and product improvement
- Sentry: For crash reporting and error monitoring
Your use of these third-party services is subject to their respective terms and privacy policies:
11. Social Features and User Conduct
11.1 Friends Feature Overview
The Friends feature allows you to share your sobriety progress with other MeSober users:
- Requires mutual consent - both parties must approve the friend request
- Shared data includes display name, current streak, last 7 days consumption, and challenge participation
- Data is shared via Apple's CloudKit infrastructure
- All sharing is encrypted end-to-end using Curve25519 encryption
- Friends can only see your last 7 days of data, not your full history
11.2 Display Names
When using the Friends feature, you choose a display name:
- Display names do not have to be your real name
- You are responsible for choosing appropriate display names
- We reserve the right to require changes to offensive, abusive, or misleading display names
- Display names should not impersonate others or violate third-party rights
11.3 User Conduct
When using social features, you agree not to:
- Use offensive, abusive, harassing, or misleading display names
- Harass, bully, or intimidate other users via poke notifications or other features
- Share inappropriate, offensive, or harmful content in friend interactions
- Attempt to identify, contact, or locate users outside the app without their consent
- Abuse the friend request system (spam, unwanted requests, harassment)
- Misrepresent your identity or impersonate others
- Use the Friends feature for commercial purposes or advertising
- Violate other users' privacy or share their information without consent
11.4 Poke Feature
The Poke feature allows friends to send friendly nudge notifications:
- Intended as friendly encouragement to check in, not for harassment
- Rate-limited to one poke per friend every 6 hours to prevent abuse
- Misuse of the poke feature (harassment, spam) may result in feature restriction
- Recipients can remove friends at any time to stop receiving pokes
11.5 Blocking and Reporting
- You can remove any friend at any time by opening the Friends list and selecting "Remove Friend"
- Removing a friend immediately deletes all shared data and stops all notifications
- We may add reporting mechanisms in future versions to address abusive behavior
- We reserve the right to investigate reports of abuse and take appropriate action
11.6 No Guarantee of Accuracy
Important: Friend data shows what friends log in the app. We cannot verify the accuracy of friend-reported data. Friends' progress is self-reported and intended for motivation only. Do not rely on friend data for any health-related decisions.
11.7 Privacy and Data Sharing
By using the Friends feature, you acknowledge and agree that:
- Your display name, streak, last 7 days consumption, and challenge status will be visible to approved friends
- Friends can see when you last checked in
- You can control who sees your data by only approving friend requests from people you trust
- You can stop sharing at any time by removing friends
- Shared data is stored in CloudKit and subject to Apple's terms and privacy policies
12. Purchases and Refunds
MeSober is currently a free application. If in-app purchases are introduced in the future:
- All purchases are processed through Apple's App Store
- Refund requests must be submitted directly to Apple
- We do not have access to your payment information
- Apple's refund policies will apply to all purchases
13. Limitation of Liability
Important Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim, or EUR 50, whichever is greater.
This limitation applies to all claims, including but not limited to:
- Disputes arising from the Friends feature or social interactions
- Issues related to friend-shared data accuracy or privacy
- Harassment or abusive behavior by other users
- Data loss or corruption in CloudKit
- Analytics or crash reporting data collection
14. Indemnification
You agree to indemnify and hold harmless DENIS MOSKALETS autonomo from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you create or submit through the Service
- Your use of the Friends feature or interactions with other users
- Your display name or any content shared with friends
- Disputes with other users arising from social features
- Abusive or improper use of poke notifications or friend requests
15. Medical and Health Disclaimer

MeSober is NOT a medical device or treatment tool.
- It does not provide medical advice, diagnosis, or treatment
- It is not a substitute for professional medical care
- If you have concerns about alcohol dependency, seek professional help immediately
- Do not use this app as a basis for medical decisions
- Consult healthcare professionals for any health-related concerns
Emergency Resources: If you or someone you know is struggling with alcohol, please contact local health services or emergency services.
16. Termination
16.1 Your Right to Stop Using the Service
You may stop using our Service at any time by:
- Uninstalling the application
- Using the "Delete All Data" button in Settings to remove all data
16.2 Our Right to Terminate
We may discontinue the Service or terminate your access if you breach these Terms or if required by law. This includes but is not limited to:
- Abusive or harassing behavior towards other users
- Spam or abuse of the Friends or Poke features
- Use of offensive or inappropriate display names
- Violation of other users' privacy or rights
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any legal proceedings, you agree to contact us at [email protected] to attempt to resolve any dispute informally. We will try to resolve the issue within 30 days.
18.2 Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. If informal resolution fails, any disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of our Service.
